Dissolution/Divorce
Divorce cases and legal separation cases look almost exactly the same. You can obtain child custody orders, divide assets and debts, and obtain child and spouse (aka alimony) orders. But at the end of the legal separation case you are still legally married to your spouse.

When individuals have children but are not married, the type of legal court case to obtain child custody and child support orders is called a “paternity action”. If paternity has not already been established, this will also be handled in this type of case.
Paternity
If there has been a change of circumstances since a child custody or child/spousal support order was made, the parties may also mediate the new terms that would be contained in Stipulation and Order with the court. This is handled much more quickly than the underlying court case since it is only modifying a portion of the prior Judgment.
Modification of Prior Orders
More and more clients with an upcoming wedding date are having the terms of their prenuptial agreement established with the help of a mediator instead of the typical back-and-forth between two attorneys. Each party should still have their own independent attorney review the prenup before signing, but the neutral mediator can streamline the process of determining the terms and language of the agreement with the participation of both parties up front.
Prenuptial Agreements
Some clients would like to divide or alter (transmute) the character of assets, debt or even their income after they have married, but they do not wish to involve the court. A postnuptial agreement is a contract for parties wishing to remain married and not have a case filed at court. Just like a prenup, the parties would have their own independent attorney review it with them prior to signing, but negotiating the terms with the mediator could greatly save time and money.
